These Terms & Conditions, together with our Privacy Policy, provide information about Heritage Foundry Limited and set out the legal terms and conditions on which we sell products through this website.

These Terms apply to any contract between you and us for the sale of products. Please read them carefully before placing an order.

By placing an order through our website and accepting these Terms & Conditions where prompted, you confirm that you agree to be bound by them.

We may amend these Terms from time to time. The Terms in force at the time you place your order will apply to that order.

These Terms, and any contract between us, are in the English language.

2. Our Products

2.1 Images of products on our website are provided for illustrative purposes. Although we make reasonable efforts to display colours, finishes and product details accurately, the appearance of colours may vary depending on your device, display settings and lighting conditions.

Products supplied may therefore vary slightly in appearance from website images.

2.2 Cast iron is a traditional manufactured material and variations in surface texture, casting marks and minor imperfections are inherent characteristics of the manufacturing process. These characteristics do not necessarily constitute defects.

2.3 All products shown on our website are subject to availability. If a product you have ordered is unavailable, we will contact you as soon as reasonably possible.

2.4 Recommendations regarding the use, selection or installation of products are based upon our experience and the information available to us. Conditions in which products are subsequently transported, stored, installed, maintained or used are outside our control.

You are responsible for ensuring that products are suitable for the intended application and installation conditions.

2.5 We reserve the right to make reasonable changes to product specifications where necessary to comply with legal or regulatory requirements, improve a product, accommodate manufacturing requirements or where a change does not materially affect the quality or performance of the product.

3. How We Use Your Personal Information

3.1 We process personal information in accordance with our Privacy Policy.

Please read our Privacy Policy carefully as it explains how information provided to us is collected, used and protected.

4. Title and Risk

4.1 Responsibility for the products will pass to you when delivery has been completed at the delivery address supplied with your order.

4.2 Where you purchase products as a business, ownership of the products will not pass to you until we have received payment in full and cleared funds for those products and any other sums properly due to us.

4.3 Until ownership passes to a business customer, the products must, where reasonably practical, be stored separately, adequately protected and identifiable as products supplied by Heritage Foundry Limited.

4.4 A business customer may resell or use products in the ordinary course of its business before ownership passes, unless the customer's right to possession has ended under these Terms.

4.5 If payment becomes overdue, we may exercise any rights available to us under these Terms and applicable law.

5. Business Customers

5.1 If you place an order on behalf of a business, company, partnership or other organisation, you confirm that you have authority to bind that organisation.

5.2 These Terms, together with any documents expressly referred to within them and our Privacy Policy, constitute the agreement between you and us in relation to your purchase.

Nothing in this clause limits any rights which cannot lawfully be excluded.

6. How the Contract Is Formed

6.1 Our checkout process allows you to review your order and correct errors before submitting it. You should check product descriptions, quantities, finishes, colours, delivery details and other selections carefully before placing your order.

6.2 After placing an order, you will normally receive an email acknowledging receipt of your order. This acknowledgement does not necessarily constitute acceptance of your order.

6.3 Our acceptance of your order takes place when we confirm that the order has been accepted or dispatched. At that point a contract will exist between you and Heritage Foundry Limited.

6.4 If we cannot supply a product because it is unavailable, discontinued, incorrectly described, incorrectly priced or for another reasonable reason, we will contact you.

If payment has already been taken for products we cannot supply, the relevant amount will be refunded.

7. Our Right to Vary These Terms

7.1 We may revise these Terms from time to time, including where necessary because of:

  • changes to our products or services;
  • changes to payment or delivery methods;
  • changes to our website or ordering process;
  • changes in applicable laws or regulatory requirements; or
  • changes to our business operations.

7.2 The Terms in force when your order is placed will normally apply to the contract for that order.

8. Default or Insolvency of a Business Customer

8.1 This section applies to business customers and may apply where:

  • you materially breach your obligations under these Terms;
  • payment owed to us becomes overdue;
  • you become insolvent or unable to pay your debts;
  • a receiver, administrator, liquidator or similar officer is appointed over your business or assets;
  • steps are taken towards winding up or dissolution of your business;
  • you cease or threaten to cease trading; or
  • we reasonably believe that one of the above circumstances is about to occur.

8.2 Where this section applies, we may, subject to applicable law, demand payment of outstanding amounts, suspend further deliveries or cancel outstanding contracts.

9. Delivery

9.1 Any delivery date provided by us is an estimate unless we expressly agree otherwise.

We will make reasonable efforts to fulfil your order by the estimated delivery date. Delivery may be affected by stock availability, manufacturing lead times, order size, delivery location, carrier availability or events outside our reasonable control.

9.2 Delivery is completed when the products are delivered to the address specified in your order.

9.3 You are responsible for providing a complete and accurate delivery address, suitable contact details and details of any restrictions affecting delivery.

Cast Iron and Pallet Deliveries

9.4 Many cast iron orders are heavy and are therefore delivered using palletised freight.

Our standard pallet delivery is generally a kerbside delivery service. Where possible, products may be unloaded using a tail lift and pallet truck.

9.5 Pallet trucks require a firm, flat and suitable surface. Drivers may not be able to move pallets across gravel, grass, steep gradients, uneven surfaces, soft ground or other unsuitable surfaces.

9.6 Due to the weight, dimensions or configuration of some orders, it may not always be possible to lower a pallet using a standard tail lift. We will advise you where alternative arrangements are required when reasonably possible.

9.7 You must tell us when placing your order about any delivery restrictions, including:

  • narrow roads;
  • weight, width or height restrictions;
  • restricted access;
  • pedestrianised areas;
  • building sites requiring booking-in;
  • limited delivery hours;
  • properties unsuitable for large vehicles; or
  • any requirement for a smaller delivery vehicle.

9.8 Additional costs resulting from inaccurate or incomplete delivery information, failed delivery attempts or special delivery requirements may be charged to you where permitted by law.

9.9 Pallet deliveries may require a delivery appointment or booking. If we or our carrier cannot contact you, delivery may be delayed.

9.10 You should inspect the delivered products as soon as reasonably possible.

Any visible shortage, transit damage or discrepancy should be reported to us promptly and, where reasonably possible, within 48 hours of delivery. This notification request does not affect any statutory rights available to consumers.

9.11 Painted cast iron products delivered on pallets should ideally be unpacked within 48 hours of delivery and stored appropriately to prevent trapped moisture or damage to the painted finish.

10. International Delivery

10.1 We do not currently provide standard website delivery to addresses outside the United Kingdom.

10.2 Customers outside the United Kingdom may place an order for delivery to a UK address.

10.3 In some circumstances we may agree separately to arrange delivery outside the United Kingdom. Such delivery must be agreed with us before ordering and additional charges may apply.

10.4 Where international delivery is agreed, the customer may be responsible for import duty, local taxes, customs charges, clearance fees and other charges applicable in the destination country or territory.

11. Product Prices and Delivery Charges

11.1 Product prices will be displayed on our website from time to time. We take reasonable care to ensure pricing information is accurate.

11.2 Prices may change without notice, but a price change will not normally affect an order that we have already accepted.

11.3 Where applicable, our website will identify prices excluding VAT and/or including VAT. The VAT applicable to your order will be shown during the ordering process.

11.4 Product prices do not necessarily include delivery charges. Applicable delivery charges will be calculated or displayed separately.

Pricing Errors

11.5 Despite our reasonable efforts, a product may occasionally be incorrectly priced.

If the correct price is lower than the price charged, we will charge or refund the appropriate lower amount.

If the correct price is higher than the price displayed, we may contact you before dispatch and give you the option of continuing with the order at the correct price or cancelling it.

11.6 If a pricing error is obvious and could reasonably have been recognised as an error, we are not obliged to supply the product at the incorrect price where the law allows us to cancel the order.

12. Payment

12.1 You may pay using the payment methods made available through our website or otherwise agreed with us.

12.2 Unless we have agreed credit terms or another arrangement with you in writing, payment for products and applicable delivery charges is required in advance.

13. Product Information, Finishes, Warranty and Returns

Product Condition

13.1 Unless a manufacturer's warranty applies, we warrant that products supplied by us will be free from material defects at the time of delivery, subject to these Terms and your statutory rights.

13.2 This does not cover problems resulting from circumstances such as:

  • fair wear and tear;
  • wilful or accidental damage;
  • incorrect installation;
  • incorrect preparation or painting;
  • abnormal storage or environmental conditions;
  • negligence by you or another person;
  • failure to follow applicable installation or maintenance instructions;
  • alteration or repair carried out incorrectly;
  • damage caused by incompatible materials or chemicals; or
  • a specification supplied by the customer.

Cast Iron in Coastal Environments

13.3 Coastal and other aggressive environments can accelerate corrosion of cast iron and deterioration of protective coatings.

A suitable protective coating system and a strict, frequent inspection and maintenance regime should therefore be used where cast iron is installed in these environments.

Any damage to protective coatings and any cut, drilled or otherwise exposed bare-metal surfaces should be appropriately prepared and protected before final installation.

Galvanised Steel Brackets

13.4 Painted galvanised steel brackets may behave differently from painted cast iron because of differences in the underlying material and coating adhesion.

Paint can occasionally be damaged during transportation or installation. We recommend inspecting brackets after installation and touching up any affected areas with an appropriate coating.

Transit Primed Cast Iron

13.5 Transit primed cast iron products are supplied with a protective primer intended primarily to provide short-term protection during transport and appropriate undercover storage.

Transit primer should not normally be regarded as the final protective coating.

Preparation and application of the final protective paint system on site are the responsibility of the installer or contractor unless the products have been supplied with one of our finished coating systems.

The appropriate final coating specification should take account of the installation location and environmental conditions.

Cast Iron Manufacturing Characteristics

13.6 Traditional cast iron products are manufactured using casting processes which can naturally produce variations in surface texture, minor marks and other casting characteristics.

These characteristics may be more noticeable with lighter coloured finishes.

Rainwater and soil pipe lengths may also be manufactured using spinning or centrifugal casting processes appropriate to the product.

Business Returns

13.7 The following provisions apply to returns by business customers. Consumer returns are dealt with separately in Section 15.

Products must not be returned without prior authorisation from Heritage Foundry Limited.

13.8 Unless agreed otherwise:

  • specifically ordered, bespoke, fabricated, altered or made-to-order products cannot normally be returned;
  • non-stock products cannot normally be returned;
  • products accepted for return must be in a resaleable condition;
  • the customer is responsible for adequately packaging returned products;
  • the customer bears the risk of return until products are received by us;
  • return transport costs are normally the responsibility of the customer unless products are faulty because of our breach; and
  • a reasonable restocking or handling charge may apply to business returns where agreed or appropriate.

14. Limitation of Liability for Business Customers

14.1 This Section 14 applies where you purchase products wholly or mainly for business purposes.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation;
  • breach of obligations relating to title to goods; or
  • any other liability which cannot legally be excluded or limited.

14.2 Subject to Section 14.1 and to the fullest extent permitted by law, we will not be liable to a business customer for:

  • loss of profits;
  • loss of sales or revenue;
  • loss of business;
  • loss of anticipated savings;
  • loss of business opportunity;
  • loss of goodwill;
  • loss or corruption of data; or
  • indirect or consequential loss.

14.3 Subject to Section 14.1 and applicable law, our total liability to a business customer arising out of or in connection with a contract shall not exceed 50% of the price paid for the products giving rise to the claim.

14.4 Except where expressly stated in these Terms or required by law, representations, conditions or warranties which might otherwise be implied are excluded to the fullest extent permitted by law.

15. Terms Which Apply If You Are a Consumer

15.1 This Section applies if you are an individual purchasing products wholly or mainly for purposes outside your trade, business, craft or profession.

If there is a conflict between this Section and another provision of these Terms, this Section will take priority to the extent necessary to protect your statutory consumer rights.

Your Statutory Rights

15.2 As a consumer, you have statutory rights in relation to goods, including rights where goods are faulty, not as described, not of satisfactory quality or not fit for a particular purpose where the relevant legal requirements are met.

Nothing in these Terms affects your statutory rights.

Cancellation Rights for Online Orders

15.3 For most products purchased online, a consumer has a legal right to change their mind and cancel the contract without giving a reason.

15.4 For goods, the cancellation period normally ends 14 days after the day on which you, or a person nominated by you other than the carrier, receives the goods.

If an order contains multiple goods delivered separately, the cancellation period may run from the day after receipt of the final item where applicable.

Products Excluded from Change-of-Mind Cancellation

15.5 The statutory change-of-mind cancellation right does not apply in certain circumstances permitted by law, including goods which are:

  • made to your specifications;
  • clearly personalised;
  • manufactured specially for you where the applicable statutory exception applies; or
  • otherwise exempt from cancellation rights under applicable consumer legislation.

This may include certain bespoke castings, fabricated products, specially manufactured radius guttering, individually customised products or other clearly personalised goods.

How to Cancel

15.6 To exercise your right to cancel, you must clearly inform us that you wish to cancel the contract before the cancellation period expires.

We recommend keeping a copy of your cancellation request.

Returning Products After Cancellation

15.7 If you cancel after receiving the products, you must normally return them to us within 14 days after informing us of your decision to cancel.

15.8 Unless the products are faulty, damaged because of our breach, incorrectly supplied or not as described, you will normally be responsible for the direct cost of returning them.

Because many cast iron products are heavy, long or palletised, return costs can be significant. Please contact us before arranging a return so that suitable arrangements can be discussed.

15.9 You must take reasonable care of the products while they are in your possession.

We may make a deduction from a refund where permitted by law if the value of products has been reduced because they have been handled more than would reasonably be necessary to establish their nature, characteristics and functioning.

Consumer Refunds

15.10 Where you validly exercise your statutory right to cancel, we will refund the amounts due in accordance with applicable consumer law.

This normally includes the price paid for the cancelled products and the cost of our least expensive standard delivery method where a delivery charge is required to be refunded by law.

If you selected an enhanced or more expensive delivery option, we are not required to refund the additional cost above our standard delivery method.

15.11 Where you are responsible for returning goods, we may withhold the refund until we receive the goods back or you provide appropriate evidence that they have been returned, whichever occurs first.

Refunds will normally be made within 14 days of the relevant date required by consumer law.

15.12 Refunds will normally be made using the same payment method used for the original transaction unless another method is expressly agreed.

Faulty, Damaged or Misdescribed Products

15.13 Your rights when products are faulty, damaged, not as described or otherwise fail to conform with your statutory rights are separate from your right to change your mind.

If you believe a product is faulty or has been incorrectly supplied, please contact us as soon as reasonably possible so that we can investigate and arrange an appropriate remedy.

Nothing in our returns policy limits your rights under applicable consumer law.

Our Liability to Consumers

15.14 If we fail to comply with these Terms, we are responsible for loss or damage which is a foreseeable result of our breach of contract or our failure to use reasonable care and skill, subject to applicable law.

We are not responsible for loss or damage which is not foreseeable.

15.15 Where you purchase products as a consumer for domestic and private use, we are not responsible for business losses such as loss of profit, loss of business, loss of revenue, business interruption or loss of business opportunity.

15.16 Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or liability which cannot otherwise legally be excluded.

16. Events Outside Our Control

16.1 We will not be responsible for a failure or delay in performing our obligations where that failure or delay is caused by an event outside our reasonable control, except where applicable law provides otherwise.

16.2 Events outside our reasonable control may include:

  • strikes or industrial disputes involving third parties;
  • civil disturbance;
  • war, terrorism or threat of terrorism;
  • fire, explosion or accident;
  • storms, flooding, earthquakes or other natural disasters;
  • epidemics or pandemics;
  • failure of telecommunications or utility networks;
  • government action or restrictions;
  • transport disruption;
  • carrier disruption;
  • shortages of materials outside our reasonable control; or
  • other events which could not reasonably have been prevented.

16.3 If such an event materially affects an order, we will take reasonable steps to contact you and minimise the effects of the delay.

Where delivery is affected, we may arrange a revised delivery date.

17. Communications Between Us

17.1 References in these Terms to communication "in writing" include communication by email where permitted by law.

17.3 Where we need to contact you in relation to an order, we may use the email address, telephone number or postal address you supplied during the ordering process.

18. Other Important Terms

18.1 We may transfer our rights and obligations under a contract to another organisation where permitted by law. Any transfer will not affect your statutory rights.

18.2 A contract is between you and Heritage Foundry Limited. Unless otherwise provided by law, no other person has a right to enforce its terms.

18.3 Each provision of these Terms operates separately. If a court or relevant authority decides that any provision is unlawful or unenforceable, the remaining provisions will continue in full force and effect.

18.4 If we delay in enforcing a right under these Terms, this does not mean that we have waived that right.

Governing Law

18.5 These Terms and contracts for the purchase of products from us are governed by English law.

If you are a business customer, the courts of England and Wales will have exclusive jurisdiction in relation to disputes arising from or connected with these Terms or a contract between us, subject to any mandatory legal requirements which apply.

If you are a consumer, nothing in these Terms prevents you from exercising any rights relating to jurisdiction or bringing proceedings in a court available to you under applicable consumer law.
